Hello Harmony Music LLC, Terms & Conditions
These terms and conditions are entered into by and between parents or guardians on behalf of their child (“Students”) and Hello Harmony Music, LLC (Hello Harmony Music) , and shall govern and take effect upon registering their child as a Student for Hello Harmony Music Services. Services shall include any combination of the following:
In-Person-“Offline Learning” defined as Student’s attendance and participation that occur live and in-person during classes (sometimes referred to as club) and Camps and/ or Club meetups or jam sessions, as part of the Services facilitated by Hello Harmony Music.
“Online Learning” defined as Student access to and use of Hello Harmony Music (“Website”), including the virtual aspect of Camps or the Classes/Club (“Virtual”), and any content, videos and functionality offered on or through the Website or any third-party links and/or technology needed to execute Services.
All services will be In-Person (Live) services. Online Learning will only be offered in the event that in-person services are unable to be offered due to Covid-19 and/or Pandemic State mandated regulations.
Covid-19 Guidelines: We will follow current Covid-19 government guidelines in accordance with the law, in order to operate and provide a safe environment for all.
Masks are not required. Students may wear masks according to their preference/circumstance.
Covid-19 Limitation of Liability: Hello Harmony Music assumes no liability in the event of a Student’s exposure to Covid-19. Students participating in Hello Harmony Music Services do so at their own risk.
Registration/ Subscriptions and Cancellations:
Registration/ subscriptions must be submitted online via the registration/ subscription forms on the Website and fees are to be paid in full and received by Hello Harmony Music before the start of Services to confirm registration. Payments can be paid online with credit/ debit card or via check or Venmo upon request. All fees paid are non-refundable.
Students must fill out the intended registration form for the intended Services, which each has its specific description, Student level, start date, time periods, and/or included materials and requirements, as described on the Website.
Registration fees vary based on the Services and registration forms the Student selects and submits, and any optional add-ons selected in the forms.
If registration forms are submitted and no payment or only partial payment has been received before the start of services, registration is considered incomplete and Hello Harmony Music reserves the right to suspend or terminate the Students access to Services until all outstanding fees are paid.
Registration closes one week prior to the start of the intended service. Hello Harmony Music reserves the right to accept or deny registration if registration is confirmed less than one week prior to the start of Services.
Registration closes after 12 registered Students per Club/Class or Camp and Hello Harmony Music will not hold spots for prospective Students with incomplete registrations or partial payments. Hello Harmony Music reserves the right to expand the number of Students per Camp/Club/Class at any time.
Students are advised to attend all In-Person Learning during Services. If the student is not present for In-Person Learning, the student will not receive a refund or credit towards makeup Services.
When applicable students are advised to complete all assignments from Online Learning by the due dates given in order to receive timely, personalized feedback from Hello Harmony Music. Students forfeit their rights to receive feedback, if they miss the due dates, and Hello Harmony Music reserves the right to respond or not respond to late submissions.
Hello Harmony Music reserves the right to cancel In-person and/or Online Learning, and provide a make-up session within any of its Services.
Hello Harmony Music reserves the right to dissolve, cancel or amend any of its Services when deemed necessary and transfer Students to a similar Service at an alternate period or time. If Students are unable to transfer or accept the amendment, a pro-rated refund will be given.
Copyright, Website Access and Account Security
All materials and content used in Hello Harmony Music Services, which includes the Website, Online and In-Person Learning are copyrighted, and owned by Hello Harmony Music, its licensors or other providers of such materials and are protected by United States copyright, and other intellectual property rights laws. Students are permitted to use the materials and content facilitated by Hello Harmony Music for personal, educational and non-commercial use only.
Where applicable Hello Harmony Music will review video assignment submissions recorded by Students (“Student Videos”) for the purposes of giving critical feedback or responses to the Student and may store Student Videos for a limited time at its sole discretion. Students are responsible for saving and archiving their own Student Videos, if desired.
If Student Videos are posted and shared by the Student to any third-party media-hosting website (e.g., SoundCloud, YouTube, Facebook, Instagram, and the like), Hello Harmony Music assumes no liability for copyrightable content and the recording of persons appearing in the video.
Students are responsible for ensuring technical arrangements necessary to have access to the Website and Online Learning.
When applicable for online learning. Students may need to provide sign-in codes or registration details. Students must treat such access codes as confidential and personal and not disclose it to any other unregistered person for unauthorized access. Hello Harmony Music reserves the right to disable any sign-in codes used by a Student, if there is evidence that a Student has violated these access terms herein.
Hello Harmony Music works hard to protect digital material but does not guarantee that files available for downloading from the internet or the Website will be free of viruses or other destructive code. Students are responsible for implementing sufficient anti-virus protection on their personal computing systems.
Hello Harmony Music assumes no liability for external hacks, phishing scams, internet fraud, cybercrime and predatory behavior from online scammers and predators that may target Students.
General Rights, Warranties and Liabilities.
All Hello Harmony Music Services will be taught by Mrs. Schwartz, who holds the relevant qualifications to competently execute Services.
To ensure the Student achieves maximum potential from Services, parents or guardians are advised to ensure that the Student arrives at the correct time with their learning materials and instruments for In-Person learning, and when applicable to monitor the Student’s practice at home and completion of assignments.
Hello Harmony Music will use its best efforts to provide a safe working environment for Students, including safeguarding any Student who lists student’s allergies in the registration forms, but will not bear any liability or responsibility for any claims, damages, loss of property, personal injuries, or allergic reactions sustained by the Student during any activity associated with Hello Harmony Music, or within the premises of Offline Learning.
Parents/guardians of Students are requested to keep their child at home if he or she has flu like symptoms (consistent sneezing and/or coughing), fever, or any infectious disease.
Hello Harmony Music reserves the right to take pictures or videos of the students and/or use the student's work sample for publicity and promotional purposes, except where specifically denied by the parent in the Notes/ Additional Info of the registration/ subscription forms.
Hello Harmony Music reserves the right to include or exclude any individual or organization at its discretion within the boundaries of the law.
Changes to Terms and Conditions: Hello Harmony Music reserves the right to include, delete or change any of the above terms and conditions with or without prior notice and amendments will be posted to this page. All changes are effective immediately when we post them, and apply to the use of the Website and Services thereafter.
Privacy Policy
Information collected by Hello Harmony Music registration forms is personal information, as defined by the Privacy Act 1998 and includes parent/ guardian’s first name, last name, child’s name, child’s school, email address, telephone number and postal address. Hello Harmony Music uses personal data entered on registration forms so that parents/ guardians can identify themselves when registering a child as a Student, to be contacted about registration, and to be kept informed of matters that may be of interest. Personal information is not used for commercial purposes and is not distributed to any other organization for any purpose.
